Copyrights and intellectual property
Reproduction of artworks
Most of the artwork images that the MAC makes available on its website are protected by copyright. To ensure full protection of its rights, the MAC requests that users not reproduce any of the images posted on its website for any uses other than fair dealing as provided under the Copyright Act, notably for the purpose of private study, research or education. In such cases, the Musée requests that users fully credit the work with the artist’s name, the title of the work and any other indications.
Any modifications to an images likely to compromise the integrity of the artwork, such as cropping the image, adding extraneous elements or altering the colours, are prohibited.
Under no circumstances may the Musée be associated with a brand, product, project or undertaking via the use of an image available on its website. Moreover, any reproduction for a use other than fair dealing as defined in the Copyright Act is forbidden without the prior written consent of the Musée to that effect.

The Musée may not be held liable for any third-party use of images drawn from its website which would contravene any copyright legislation.
Website content
The MAC authorizes the use of its website content for private use only, providing that the Musée d’art contemporain de Montréal is acknowledged as the source.

Integrity of information
The Musée and its Fondation guarantee the accuracy of the posted information as at the exact moment it appears on its website, not later. The Musée and its Fondation do not accept any liability for any document, data or other content from the moment it is altered or modified in any way, before or after downloading. Moreover, in the event of any discrepancy between an official text and the content of this website, the official text shall prevail.
Social media and newsletter
The Musée and its Fondation inform visitors of their activities by social media or through their newsletters. Subscriptions to the MAC’s social media sites are on a voluntary basis. The parameterization of information received (language choice, frequency of notices) is also done by the user. Users are urged to comply with certain basic rules of use, as detailed in the MAC’s Netiquette posting.

NOTICE OF CONFIDENTIALITY CONCERNING PERSONAL INFORMATION
Scope of the Notice
The Musée d’art contemporain de Montréal (hereinafter the “MAC”) places utmost importance on protecting your personal information that it gathers in the context of its activities, including information gathered when you visit its website and use its online services.
The present notice of confidentiality (hereinafter the “Notice”) describes the protection of personal information practices that the MAC is committed to complying with in the context of its activities in order to ensure that your personal information that it holds is protected in compliance with the regulations and laws in effect that apply to the MAC.
The MAC and its Foundation take every precaution necessary to ensure the confidentiality of personal information and to act in compliance with the Act respecting Access to documents held by public bodies and the Protection of personal information.
Field of application of the Notice
This Notice reflects the MAC’s constant commitment to protecting the personal information of the following individuals:
- Members of the general public (whether or not they have visited the MAC)
- Members of the MAC
- Participants in the MAC’s programs, events, and activities (school, community, and all other types)
- Members of MAC’s staff and board of directors
- Job applicants (whether through its website or by any other means)
- The MAC’s partners and contributors
- All physical persons whose personal information are collected or processed in the context of the MAC’s activities
Definition
For the purpose of the present Notice, “personal information” is defined as all information that concerns a physical person and that makes it possible to identify that person directly (e.g., last name, first name, email address, postal address) or indirectly (e.g., information that, combined with other information, allows the person to be identified).
Guiding principles concerning protection of personal information
The MAC’s protection of personal information practices are based on the following guiding principles:
1. Consent
Before collecting, using, or disclosing your personal information, the MAC makes sure to obtain your consent in compliance with the applicable requirements, unless an exception is provided for by law (e.g., in connection with a criminal prosecution).
You can withdraw your consent to the MAC’s use of your personal information for uses that are not essential to the services provided by the MAC—for example, to send you promotional communications, or to solicit you to donate to the Fondation du MAC, to generate statistics, or to analyze your data. If you so wish, the MAC will stop using it for these purposes.
Please note, however, that it will not be possible to withdraw your consent for the use of your personal information essential to the management and administration of certain services that are provided to you by the MAC without ending your business relationship with it (e.g., related to your membership, your participation in targeted educational programs or in events, or your job or application in response to a job posting).

2. Collection
a) Nature of the personal information collected
The MAC makes sure to collect only the personal information that is needed to conduct its activities and for purposes to which you have consented. This information may include:
- Your identification information, such as your last name, first name, email address, postal address, and telephone number
- Your financial information, such as information on your credit card or your banking information
- Information that is necessary to optimize your experience on its website, such as your IP address and your location or navigation data
- Personal information, such as information found in your curriculum vitae or your job application, or your language preference
- Information on your health and safety, including allergies, accessibility needs, and other data.
The MAC takes care to ensure that the personal information that it holds on you is up to date and accurate at the time it uses it.
b) Personal information on minors
In the context of its educational programs, the MAC may collect the personal information of a minor and the emergency contact information for his or her parent or guardian in order to confirm the minor’s identity or see to his or her health and safety in the context of activities in which he or she participates.
In these cases, the MAC always make sure to obtain prior consent from the parent or guardian or from a person who has received a “delegation of parental authority” (such as a teacher) for the minor before collecting his or her personal information.
c) Collection methods
Directly from you
Most of the personal information that the MAC collects is what you provide directly, particularly when:
- You communicate with it
- You create an online account
- You make an order or a reservation
- You browse its website
- You make a donation
- You become a member of its staff or board of directors
- You apply for a position
- You participate in surveys or contests
- You are involved in the organization of an exhibition, a program, or an event
- One of your artworks or an archival fonds is acquired for integration into the MAC’s collection, by gift or by purchase
Video surveillance
The MAC uses surveillance cameras to ensure your safety as well as that of its staff and to protect installations and artworks for which it is responsible. Images of you collected by the MAC’s surveillance cameras are considered personal information and are treated in compliance with the protection principles in the manner stated in this Notice.
From a third party
The MAC may also collect your personal information from third parties or from authorized representatives with your consent, or if the law authorizes it to collect this information in this way.
Through “cookies”
When you access the institutional website and microsites (including digital projects such as the MACrépertoire) maintained by the MAC, cookies (small text files) are stored on your computer. Cookies may gather personal information such as your IP address and are aimed at improving your browsing experience and the content of the MAC’s website.
The MAC may deposit the following categories of cookies on your computer:

The MAC collects your personal information for the following purposes:

- To process your orders, reservations, and payments related to access to the MAC’s galleries or programs, activities, and events
- To confirm your identity and verify the accuracy of your personal information
- To manage your visitor, member, employee, or board of directors member file
- To provide support and assistance
- To send invitations to its events, programs, activities, surveys, and public newsletter
- To organize and coordinate events, meetings, programs, and other activities
- To solicit donations to the Fondation du MAC and to thank you
- To send promotional communications
- To analyze your data and generate statistics
- To manage and optimize its website and its online services and adapt the navigation experience to your needs
- To assess your application for a position
- To detect and prevent fraud and all other illicit activities
- To meet its legal and regulatory obligations
- To obtain reproduction licences and negotiate other rights according to the Copyright Act and the agreements in force
- To document acquisitions of works and archival fonds to meet current and future needs, including conservation
The MAC and its Foundation do not retain any credit-card numbers provided during an online transaction on its website unless you consent to automatic renewal of your membership.

4. Communication
The MAC ensures that the personal information that it holds is accessible only to employees and other MAC staff members who must have access to it in the course of their duties.
a) Communications to the Fondation du MAC
The MAC may communicate your personal information to its Foundation, which is a moral person independent of the MAC and a registered charity whose mission is to support the MAC.
The MAC and its Foundation share common resources (website, database, etc.) and objectives. To facilitate achievement of these objectives, they may exchange your personal information for the purposes set out in this Notice. For example, the MAC may communicate personal information to its Foundation to thank you for your donation or invite you to special events, or to generate statistical reports.
To the extent that the MAC hosts its Foundation’s website on its servers, all confidentially practices associated with the Foundation’s website are subject to the present Notice. All other collection, use, communication, and retention practices for your personal information by the Foundation are set out according to the guiding principles in its Privacy Statement, which can be found here: https://macm.org/en/foundation/.
b) Communications to third parties
The MAC may also communicate your personal information to business partners, service providers, governmental authorities, and other third parties in the context of its activities.
These third parties include:
- Payment services providers
- Marketing or advertising services providers
- Companies specializing in credit and criminal background checks
- Digital solutions providers
- Customer relationship management (CRM) solutions providers
- Data-hosting, server, and system services providers
- Employee assistance program (EAP) and group insurance providers
- Financial and human-resources processing providers
- Control authorities, such as the Commission d’accès à l’information;
- All other entities legally authorized to obtain it
The third parties to which your personal information is communicated are carefully selected by the MAC. They commit by contract to comply with the Politique d’accès aux documents et de protection des renseignements personnels du MAC and the applicable laws and regulations and to apply all security measures designed to protect your personal information. Particular attention is paid to the renewal of contracts whose start date antedates the coming into force of certain terms and conditions of the laws and regulations applicable to protection of personal information.
In the context of its activities, the MAC may communicate your personal information to third parties situated outside of Québec. In this case, the MAC makes sure to validate beforehand the laws and personal information protection practices applicable in the locations concerned and to institute the necessary protection measures, if necessary.
5. Retention et destruction
The MAC retains your personal information for the period necessary for the uses for which it was gathered and following the applicable retention times.
When your personal information is no longer needed for the purposes for which it was collected, the MAC will destroy it according to a process that ensures its confidentiality and security.
6. Security
The MAC applies security measures proportional to the degree of sensitivity of the personal information it holds, the context of its use, its quantity, its distribution, and its medium. These security measures are aimed at protecting your personal information against loss, theft, and unauthorized access, use, or communication.
The security measures applied by the MAC include:
- Administrative measures such as indexed filing of paper files containing personal information; ongoing training and awareness-raising for all staff on the need to ensure the security of personal information; a retention schedule for documents according to their nature and use; assessment of the risks linked to implementation of a solution involving personal information; and creation of an access to information and protection of personal information committee
- Physical measures such as ensuring that filing cabinets and premises that contain the paper files containing personal information are under lock and key; limiting access to such paper files to certain staff members; and control of access to the MAC’s premises
- Technological measures such as limiting access to digital files containing personal information to certain staff members; two-factor authentication for access to the MAC’s accounts and networks; and automatic locking of workstations
7. Your rights regarding your personal information
The MAC respects your rights regarding your personal information that are attributed to you by law and applies procedures to ensure that they are observed..
Access and modification
You have the right to consult the personal information concerning you that is held by the MAC, to verify its accuracy, and to request that it be corrected, if applicable, subject to the exceptions set out in the law.
Information and complaints
You also have the right to request information on how your personal information is processed (e.g., uses, categories of third parties to which it is communicated, applicable retention times, retention locations) and to file a complaint if this processing does not comply with the principles stated in the present Notice and with the laws and regulations applicable to the protection of personal information.
